OFFICIAL RULES
These are the Official Rules for the Women of Today Custom Hat Sweepstakes (“Sweepstakes”). Your submission of an entry confirms that you meet the eligibility requirements and accept these Official Rules and the decisions of Women of Today, Inc. (“WOT” or “Sponsor”) concerning the Sweepstakes and these Official Rules.
NO PURCHASE NECESSARY OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. Void where prohibited or restricted by law.
ELIGIBILITY AND ENTRY
This Sweepstakes is open to legal residents of the United States, and the District of Columbia, excluding Rhode Island, who are 18 years of age or older at the time of entry. Submission of an entry constitutes your agreement to these Official Rules and constitutes a binding contract between you and Sponsor.
To be eligible, Instagram comments must be received by June 4, 2023 11:59 PM PST or postcards must postmarked by June 10, 2023, (the “Sweepstakes Period”). During the Sweepstakes Period, you can enter the Sweepstakes by commenting on the Women of Today Official Hat Instagram Sweepstakes post or sending a postcard with your comment to Women of Today, Inc., Attn: LD, PO Box 88, Berwyn, PA 19312 with name, address, email address and phone number. The Official Hat Instagram Sweepstakes post will be posted on or about June 4, 2023, on the Women of Today Instagram Page. Sponsor is not responsible and shall not be liable for late, incomplete, undelivered, or lost entries, or for network or service failures or malfunctions. Entries that are garbled in transmission, incomplete, not received or lost shall not be taken into consideration. Entries become the sole property of Sponsor.
Limit one entry per person.
In the case of multiple or incomplete entries, an entrant may be disqualified from participation at the sole discretion of Sponsor. Employees, directors, officers, and agents of Sponsor, and their immediate family or household members are not eligible to participate. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting partners or significant others.
Any attempt to tamper with the entry process or otherwise undermine the legitimate operation of the drawing may be a violation of criminal and civil laws.
PRIZE
The winner will receive one virtual hat fitting session with Aspen Hatter for one custom hat. If winner is in Austin, Texas, or elects to travel to Austin, Texas at the winner’s own expense, the winner has the option to attend the hat fitting session in person. Value of prize $1200 US (the “Prize”).
SELECTION OF PRIZE WINNER BY RANDOM DRAWING AND NOTIFICATION OF WINNER
One winner will be selected by random drawing, which will occur on or about Monday, June 12, 2023. The random drawing will be conducted by Sponsor or its designated representatives, whose decisions are final.
The winner shall be notified either via Instagram handle or e-mail address if the entrant sent a postcard to enter. Sponsor shall have no liability whatsoever for any problems or any deficiency concerning any address, delivery, email site or service, computers, or networks.
Odds to win depend on the total number of eligible entrants. All entrants have an equal chance of winning.
If the potential winner is ineligible, or declines or forfeits the Prize, Sponsor in its sole discretion may conduct a further random drawing to identify an alternate potential winner. The winner has 24 hours to respond to notification that the individual is the winner by either Instagram Direct Message or e-mail if postcard was sent.
No substitutions for the Prize shall be offered and right to the Prize is non-transferable.
TAXES AND LICENSING FEES
The winner will be responsible for any state, federal or local taxes, or other fees or surcharges that may be levied due to the Prize.
PRIVACY AND USE OF INFORMATION/ENTRY
By submitting an entry in this drawing, you consent to the Sponsor’s use of the information you submit to conduct this drawing. Further, the winner grants Sponsor permission to disclose the Prize winner’s name (in the form of Instagram handle or first initial and last name if a postcard is remitted), for identification of the winner.
OTHER TERMS AND CONDITIONS
IN NO EVENT SHALL SPONSOR OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS, INCURRED BY ENTRANT OR ANY THIRD PARTY, WHETHER BASED ON WARRANTY OR IN CONTRACT, TORT, OR OTHER LEGAL THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITIES OF SUCH DAMAGES, ARISING FROM THE SWEEPSTAKES, PRIZE OR USE OF A PRIZE, EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Sponsor reserves the right in its sole discretion to modify these Official Rules and/or cancel the drawing at any time without notice. If, for any reason, the Sweepstakes cannot be run as planned for reasons which include, without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, U.S. Postal Service disruptions or delays, the COVID-19 or other pandemic, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award the Prize in a manner deemed fair and equitable by Sponsor.
You agree that Sponsor and its affiliates shall have no liability for unsuccessful efforts to notify any winning entrant, or for any injuries, losses, or damages by reason of your participation in the drawing or use of any Prize, and they assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or for any unauthorized access to any website (including Sponsor’s website), email, or other service.
By accepting the Prize, the winner agrees to release and hold harmless Sponsor, its directors, employees, officers, affiliates and agents from any and all liability, loss or damages arising from or in connection with awarding, receipt and/or use of a Prize or participation in Prize-related activities, and they shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in or winning this drawing.
Sponsor reserves the right at its sole discretion to disqualify individuals who violate these Official Rules, misrepresent themselves or provide misleading information to Sponsor. Entrants agree to be bound by the decisions of Sponsor. Participants who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.
Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims or ambiguities concerning the Official Rules, and Sponsor’s decisions shall be final. If any provision of these Official Rules is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these rules, which shall remain in full force and effect. Sponsor reserves the right to modify or terminate the drawing to make such other decisions regarding the administration or outcome as Sponsor deems appropriate. All decisions by Sponsor are final.
This drawing is governed by the laws of California, and all entrants agree to personal jurisdiction and venue in Los Angeles County, California for the resolution of all actions, litigation, claims and disputes, and agree that all actions, litigation, claims and disputes shall be brought in a court with competent jurisdiction in Los Angeles County, California.
